Attorney Lora Gleicher Obtains Settlement in a Slip & Fall Case

On May 16, 2017, Attorney Lora Gleicher of Silbowitz, Garafola, Silbowitz & Schatz, LLP has helped a client obtain a settlement after a jury verdict held the defendant—a Starrett City apartment complex—liable for negligence.

In January 2014, 84-year-old Sylvia Charles suffered a serious injury in a fall on thick ice while using a walkway on the property. As a resident of the complex, she complained that the complex failed to provide property maintenance to ensure the property was always safe.

The property owner contends that Charles experienced the fall due to slippery conditions due to the inclement weather. Two days before the incident, the area was engulfed in a snowstorm.

However, Gleicher said that the freezing rain that had plagued the area had stopped at the time Charles was involved in the accident.

In the end, the jury decided the complex was liable for the defendant’s injuries. Although the trial was supposed to continue to determine the monetary damages with a new jury, a settlement was reached for an undisclosed amount.
