The Legal Consequences of Negligent Driving

The Legal Consequences of Negligent Driving

Based on the statistics on road traffic accidents gathered by the National Transport Highway Safety Authority (NTHSA), there is a huge gap between the number of accidents caused by young and mature drivers. Apparently, teenage drivers are twice as likely to cause road accidents. Consequently, this fact translates to a high number of younger drivers getting either seriously injured or being killed in these accidents.

Most of these traffic accidents are generally caused by driver error or negligence. For younger and teenage drivers, there are several factors involved. One factor would be their lack of driving experience. They are also more likely to be distracted while driving and may even be doing dangerous things due to peer pressure. Another factor would be driving under the influence of alcohol and even drugs.

Just last March in Queens, New York, a 19 year old driver was under the influence of alcohol when his Honda Sedan hit the back of a cab along Grand Central Parkway. The young driver’s car hit the cab from behind, pushing the cab into the Parkway median. To add insult to injury, the driver left the scene of the crime. The cab driver was killed in the accident. As the teenage driver left the crime scene, his bumper was left behind and the police were able to identify the driver, locate him, and arrest him soon after the incident. The driver is now facing a laundry list of charges – manslaughter, driving under the influence, homicide, and leaving the scene of the accident.

In New York, it is illegal for anyone to leave an accident scene even if one is not directly involved in the accident. There is a law that obligates the person who caused a vehicular accident to at least leave his complete name, along with his address and phone number if he needs to leave the scene of the crime. The driver will also have to call the police and notify his insurance company.
